MTI East Africa Maintains a register of Professional Mediators under a strict code of conduct. Parties are advised to consult our offices for guidance on the appointment of a suitable Mediator who is in Good standing according to our records and who has subject matter expertise. The hourly rates indicated below are guidelines for professional mediators; parties are free to agree with the mediator at appointment on rates outside the indicated range depending on the peculiarity of the matter.

• The cost of the Mediation shall be agreed in advance with each Party and an agreement should be executed to that effect.
• The professional mediators’ fees and the other expenses of the Mediation will be borne equally by the parties unless otherwise agreed by the parties.
• Payment of fees in full has to be done prior to the date of mediation.
• In Case the mediation is canceled each party will bear its own costs

Neither the Mediator nor MTI East Africa shall be liable to the Parties for any act of omission in connection with the services provided by them in, or in relation to, the mediation, unless the act or omission is shown to have been in bad faith. Parties are encouraged to take up a professional indemnity insurance cover before engaging in Mediation practice.

The experience shown in the table below is experience as a practicing Mediator and that must be disclosed to the parties if they ask for it. Parties are advised to adhere to MTI’s Mediation standards and Code of Conduct available in our mediation centre.
